Other Similar Legal Terms:

Law Terms res ipsa loquitur is A Latin term meaning the thing speaks for itself. Res ipsa loquitur is a legal doctrine or rule of evidence that creates a presumption that a defendant acted negligently simply because a harmful accident occurred. The presumption arises only if (1) the thing that caused the accident was under the defendants control, (2) the accident could happen only as a result of a careless act and, (3) the plaintiffs behavior did not contribute to the accident. Lawyers often refer to this doctrine as res ips or res ipsa.

Law Terms descriptive mark is A trademark or service mark that describes the characteristics of the product or service to which its attached. For instance, Jiffy Lube describes its purportedly fast service. Marks judged to be descriptive are initially considered legally weak and dont get much protection from the courts. If federal registration is sought, they are usually placed on the Supplemental rather than Principal Trademark Register, which also doesnt provide much protection. After a descriptive mark has been in use for five years, however, it can be moved to the Principal Register on the theory that it has by that time become well known through public exposure.

Law Terms annual meeting is A term commonly used to refer to annual meetings of shareholders or directors of a corporation. Shareholders normally meet to elect directors or to consider major structural changes to the corporation, such as amending the articles of incorporation or merging or dissolving the corporation. Directors meet to consider or ratify important business decisions, such as borrowing money, buying real property or hiring key employees.

Law Terms indecent exposure is Revealing ones genitals under circumstances likely to offend others. Exposure is indecent under the law whenever a reasonable person would or should know that his act may be seen by others--for example, in a public place or through an open window--and that it is likely to cause affront or alarm. Indecent exposure is considered a misdemeanor in most states.

Law Terms public defender is A lawyer appointed by the court and paid by the county, state, or federal government to represent clients who are charged with violations of criminal law and are unable to pay for their own defense.
