Law Terms easement by prescription is A right to use property, acquired by a long tradition of open and obvious use. For example, if hikers have been using a trail through your backyard for ten years and youve never complained, they probably have an easement by prescription through your yard to the trail.

Law Terms per stirpes is Under a will, a method of determining who inherits property when a joint beneficiary has died before the willmaker, leaving living children of his or her own. For example, Fred leaves his house jointly to his son Alan and his daughter Julie. But Alan dies before Fred, leaving two young children. If Freds will states that heirs of a deceased beneficiary are to receive the property per stirpes, Julie will receive one-half of the property, and Alans two children will share his half in equal shares (through Alan by right of representation). If, on the other hand, Freds will states that the property is to be divided per capita, Julie and the two grandchildren will each take a third.

Law Terms summary adjudication of issues is A partial summary judgment motion, in which the judge is asked to decide only one or some of the legal issues in the case. For example, in a car accident case there might be overwhelming and uncontradicted evidence of the defendants carelessness, but conflicting evidence as to the extent of the plaintiffs injuries. The plaintiff might ask for summary adjudication on the issue of carelessness, but go to trial on the question of injuries.

Law Terms circumstantial evidence is Evidence that proves a fact by means of an inference. For example, from the evidence that a person was seen running away from the scene of a crime, a judge or jury may infer that the person committed the crime.

Law Terms secondary meaning is In trademark law, a mark that is not inherently distinctive becomes protected after developing a secondary meaning: great public recognition through long use and exposure in the marketplace. For example, though first names are not generally considered inherently distinctive, Ben & Jerrys Ice Cream has become so well known that it is now entitled to maximum trademark protection.
